Cautioned Simon, “even if the right Notice is used, in most circumstances where a fixed term tenancy has expired, the Notice must expire on the correct date. Getting the Notice period wrong can be fatal to a claim, particularly if proceedings have been issued. The whole process may need to be started again which can take months, with potentially expensive consequences for the landlord”.
This technical area of Notice periods can be a minefield. Particularly in light of the increasing numbers of possessions in the recession, it is critical to get the Notice period right.
