Stage 2
The work from the First Appointment Hearing to the Financial Dispute Resolution Hearing (FDR).
A number of cases reach settlement at some time near the First Appointment Hearing. If the case has not settled by then, the Court timetable sets out a time frame for any information missing to be provided. This will be prior to the FDR Hearing. In the time before that hearing, it is expected there will be negotiations to resolve the case.
At the FDR Hearing, extensive negotiations take place in an attempt to resolve the problems. The District Judge hearing the case is told what offers have been made and can give an indication as to how he would resolve the problems were he hearing the case. The whole emphasis is on resolving the problem by negotiations. If those negotiations fail the case moves on the to the Final Hearing.
The majority of cases, which have not settled do so either at this hearing, or shortly afterwards. Invariably you will be represented by a Barrister at this hearing (the same Barrister will represent you at the Final Hearing (see below)).
If it proves impossible to settle the case, it will move forward to the Final Hearing.
All work undertaken from the conclusion of the First Appointment Hearing to the conclusion of the FDR Hearing is covered by Stage 2 of our Fixed Price Scheme for the sum of £2643.75 (inclusive of Vat, disbursements and Barrister's Fees).
If the actual costs incurred are less than this stage of the payment plan or the case settles before the conclusion of this stage of the payment plan, we will charge you the actual costs incurred as set out above.
