Planning Consultant's Certificates Of Lawful Use 100% Success Rate

Planning consultant James Cain has maintained his 100 per cent success rate with Certificates of Lawful Use at Coles Miller by gaining two more victories in North Dorset.James Cain - Solicitor, Coles Miller

Both relate to large luxury homes in the village of Todber near Shaftesbury. James’s success on his clients’ behalf has significantly increased the value of the properties involved.

James obtained Certificates of Lawful Use for two tranches of land which the owners had purchased to increase the size of their respective gardens.

North Dorset District Council had threatened the homeowners with enforcement action, saying that the land involved had been zoned for farming rather than residential use.

The issue was complicated by the fact that an orchard was involved.

But James successfully argued that – in both cases – the land had been used for residential rather than agricultural purposes.

In the last year James has won at least half a dozen planning victories relating to Certificates of Lawful Use.

They include:

  • removing the agricultural tie to an area of land in Ashington, Corfe Mullen – confirming its use as residential curtilage and increasing its value
  • confirming that a hotel on Bournemouth’s West Cliff could be used as accommodation for foreign students
  • proving that a former guest house in Boscombe had been used as a residential dwelling for at least four years, removing a potential impediment to the sale of the property.
