“The length of a clinical negligence claim will usually depend on the complexity of the factual and legal issues and also the severity of the injury.

In certain situations, you will be able to make a clinical negligence claim on behalf of somebody else – For example, in circumstances where the claimant is a minor under the age of 18. They will need a litigation friend to act on their behalf, who is over the age of 18 (usually a parent or guardian).

If somebody lacks capacity to manage their own affairs, they will also need a litigation friend or representative.

If a claim is made on behalf of the estate of a deceased person, then the personal representative of that estate will need to bring that claim.”
