I felt that Richard was helping me 100% of the time. He also reassured me on several occasions when the other side sent unpleasant letters. Family Law FAQs
How long does a divorce take in England and Wales?
The legal minimum timeframe is around six months, due to the mandatory reflection periods built into the no‑fault divorce process. However, financial negotiations or disputes involving children can extend the overall timeline. A solicitor can help keep the process moving and ensure financial arrangements are properly documented.
What happens to the family home during a separation?
The court looks at factors such as each party’s housing needs, the welfare of any children, and the financial resources available. Options may include selling the property, transferring ownership, or one party remaining until the children reach adulthood. A solicitor can advise on your rights and help negotiate a fair settlement.
How are child arrangements decided if parents cannot agree?
Parents are encouraged to resolve arrangements through discussion or mediation first. If this isn’t possible, either parent can apply to the court for a Child Arrangements Order. The court’s priority is always the child’s welfare, and decisions are based on the statutory welfare checklist. Legal advice can help you present your case clearly and focus on what is best for the child.
What is a non‑molestation order and when can I apply for one?
A non‑molestation order is a court injunction designed to protect you or your children from harassment, threats, or domestic abuse. You can apply if you are associated with the person (for example, an ex‑partner or a family member). If granted, the order makes it a criminal offence for the other party to breach its terms. Solicitors often help clients gather evidence and prepare the FL401 application to ensure the court understands the level of risk.
Do grandparents have rights to see their grandchildren?
Grandparents do not have automatic rights, but they can apply to the court for permission to seek a Child Arrangements Order. The court will consider the nature of the relationship and whether contact would benefit the child. Solicitors often help grandparents prepare applications and demonstrate the positive role they play in the child’s life.
What is a financial settlement and do I need one after divorce?
A financial settlement is a legally binding agreement that sets out how assets, pensions, savings, and income will be divided. Even if you have no assets or have already separated your finances informally, a formal settlement protects you from future claims. A solicitor can draft a consent order to ensure the agreement is enforceable.
Do I have to go to court to get a divorce?
Not usually. Most divorces in England and Wales are completed entirely online through the government’s digital portal. You only need to attend court if there is a dispute about finances or child arrangements that cannot be resolved through negotiation or mediation. A solicitor can help you manage the process efficiently and reduce the risk of avoidable hearings.
How are finances divided during a divorce?
There is no fixed formula. The court considers a range of factors, including each party’s income, earning capacity, housing needs, contributions to the marriage, and—most importantly—the welfare of any children. Settlements can include property, pensions, savings, and maintenance. Solicitors help clients understand their entitlement, negotiate fair terms, and draft legally binding consent orders.
Can I relocate with my child after separation?
If you want to move abroad or significantly change where your child lives within the UK, you usually need the other parent’s consent or a court order. The court will consider the impact on the child, the practicality of maintaining contact, and the reasons for the move. Legal advice is essential before making any plans.
What is a family injunction and how does it protect me?
A family injunction is a court order that protects individuals from domestic abuse or controls who can live in the family home. The two main types are non‑molestation orders (protecting against harassment or harm) and occupation orders (regulating who can stay in the property). Solicitors help assess which order is appropriate and prepare urgent applications where safety is at risk.
