Applying for a divorce
Since the introduction of the Divorce, Dissolution and Separation Act 2020, it has become easier for couples to apply for a divorce. An application can be made by one spouse alone or jointly with the other spouse.
The divorce process begins by submitting a divorce application to the court. If one person makes the application, they are known as the applicant, and the other spouse is referred to as the respondent. Where a joint application is made, both spouses are applicants throughout the process.

The divorce process in England and Wales is usually straightforward and is dealt with almost entirely online and through paperwork. In most cases, neither you nor your spouse will need to attend court or explain the reasons why your marriage has broken down.
For straightforward cases, the divorce process typically takes a minimum of six to seven months from the date the application is submitted to the court.
