Managing Your Credit Control
- Dealing with defended matters for both claimant and defendants
- Setting aside judgments
We assist clients with credit control procedures and also terms and conditions of business.
Unable to obtain payment? We can deal with the court’s pre-action protocols. We can – if necessary – issue court proceedings and/or enforcement proceedings on your behalf.
If your claim is defended (or you are the defendant in a claim), we can help you to:
- deal with a defence and/or counterclaim
- apply to set aside a court judgment
- apply for summary judgment
- apply to strike out court proceedings or defences.
Retention of Title Claims
Retention of title (if it is in the terms of business) may enable a seller to retain ownership of their goods until the buyer has paid for them or has fulfilled other contractual obligations.
Our lawyers can review or draft these clauses to safeguard your ownership of the goods for sale until they have been paid for in full.
We can ensure the clauses are drafted correctly so there are no loopholes.
We can also help buyers who have signed retention of property clauses to ensure the vendor fulfils their legal obligations.
Statutory Demands, Insolvency and Bankruptcy Proceedings
A Statutory Demand is a special type of written request from a creditor for payment of a debt.
An individual has 21 days to settle the debt from the date of service on them or 18 days to ask the court to set aside the demand.
After 21 days, the creditor may petition the court for a bankruptcy order (for debts of £5,000 or more).
If the debtor is a limited company or limited liability partnership (LLP), a Statutory Demand may be the initial step to obtaining a winding up order (if the debt exceeds £750).
A company faced with a Statutory Demand must either:
- reach an agreement with the creditor
- pay the debt
- provide security.
If the company fails to do so, the creditor can apply to liquidate it. We also deal with other insolvency proceedings including Administration Orders, Voluntary Arrangements and Debt Relief Orders.
Rent Arrears Recovery
Landlords from all over the UK depend on Coles Miller for help with:
- recovery of rent arrears
- possession proceedings (Section 8 or Section 21 proceedings)
- accelerated possession proceedings
- tenancy deposit claims (landlords’ failure to register a deposit or provide the prescribed information in accordance with Section 213 (1) of the Housing Act 2004 or Section 213 (5) of the Housing Act 2004).
We deal with landlord and tenant issues including repossession claims, licence to occupy and drafting tenancy agreements.
