Family Grid 2026

Applying for a divorce

Since the introduction of the Divorce, Dissolution and Separation Act 2020, it has become easier for couples to apply for a divorce. An application can be made by one spouse alone or jointly with the other spouse.

The divorce process begins by submitting a divorce application to the court. If one person makes the application, they are known as the applicant, and the other spouse is referred to as the respondent. Where a joint application is made, both spouses are applicants throughout the process.

Our experienced Family Law team can guide you through each stage of the divorce process, ensuring you understand your options and helping to make the experience as straightforward and stress-free as possible.

The divorce process in England and Wales is usually straightforward and is dealt with almost entirely online and through paperwork. In most cases, neither you nor your spouse will need to attend court or explain the reasons why your marriage has broken down.

For straightforward cases, the divorce process typically takes a minimum of six to seven months from the date the application is submitted to the court. Throughout this time, our experienced Family Law team will guide you through each stage, answer any questions you may have, and help ensure the process progresses as smoothly as possible.

Divorce FAQs

Do I need a divorce solicitor?

Instructing a specialist divorce solicitor can make a significant difference when navigating the legal, financial and emotional complexities of family matters. At Coles Miller Solicitors, we provide clear, practical advice to help you understand your rights, avoid costly mistakes and work towards a fair and informed outcome. While you are not legally required to appoint a solicitor, obtaining professional advice at an early stage can help protect your interests and provide valuable reassurance throughout the process.

How long does a divorce take?

The legal minimum timeframe is around six months, due to the mandatory reflection periods built into the no‑fault divorce process. However, financial negotiations or disputes involving children can extend the overall timeline. A solicitor can help keep the process moving and ensure financial arrangements are properly documented.

What happens to the family home during a divorce?

The court looks at factors such as each party’s housing needs, the welfare of any children, and the financial resources available. Options may include selling the property, transferring ownership, or one party remaining until the children reach adulthood. A solicitor can advise on your rights and help negotiate a fair settlement.

Do I have to go to court to get a divorce?

Not usually. Most divorces in England and Wales are completed entirely online through the government’s digital portal. You only need to attend court if there is a dispute about finances or child arrangements that cannot be resolved through negotiation or mediation. A solicitor can help you manage the process efficiently and reduce the risk of avoidable hearings.

How much does a divorce solicitor cost?

The cost of a divorce solicitor will depend on the complexity of your circumstances and the approach required. Fixed-fee options may be available for straightforward matters, such as an uncontested divorce, while contested financial or children proceedings are likely to involve more time and expense. At your free initial consultation, Coles Miller Solicitors will provide a clear and transparent estimate of costs, tailored to your individual needs and circumstances.

What is a financial settlement and do I need one after divorce?

A financial settlement is a legally binding agreement that sets out how assets, pensions, savings, and income will be divided. Even if you have no assets or have already separated your finances informally, a formal settlement protects you from future claims. A solicitor can draft a consent order to ensure the agreement is enforceable.
