Coles Miller Planning Wins AONB Appeal And Costs20th May 2014
Coles Miller has helped a small business in an Area of Outstanding Natural Beauty (AONB) to expand by winning a planning appeal and costs order.
The planning inspector awarded costs against Wiltshire Council after the successful appeal by Coles Miller Planning Consultant James Cain.
His latest planning victory centres on a home-based business which wanted to expand and construct a new office outbuilding in the garden.
Council planners had been recommended by their own officers to approve the application but instead refused following objections by the parish council and some local residents.
James appealed on behalf of the business owner. The inspector overturned the council’s refusal – making an award of costs for the authority’s “unreasonable behavior resulting in unnecessary expense.”
The inspector said the new building would be “similar in design, scale and materials to other outbuildings in the area” and – as a result – “would not harm the landscape or the scenic beauty of the AONB.”
Dorset-based Coles Miller Planning is seeing an increasing number of enquiries from outside the main Bournemouth Poole conurbation as demand for its services grows.
